High Court Rules It Cannot Interfere in Panchayat Election Process
The High Court has clarified that it cannot intervene in the conduct of panchayat elections once the official notification has been issued, citing Article 243-O of the Constitution. The court observed that the Constitution grants specific powers and procedures for local body elections, limiting judicial interference in the electoral process to ensure free and fair elections.
The ruling came in response to a petition seeking court intervention in the panchayat polls. The court emphasized that judicial restraint is essential during elections to maintain the independence of the electoral process and to uphold democratic principles.
Officials noted that once notifications for elections are published, the electoral authorities are constitutionally empowered to manage the process, including nominations, polling, and counting. The High Court stated that it would only intervene in cases involving legal violations or breaches of constitutional provisions, but routine administrative decisions during the election period fall under the purview of the election authorities.
