Karnataka HC Faults Quick Withdrawal of Advocate Appointment
The Karnataka High Court has criticised the State government for withdrawing the appointment of an advocate within 24 hours, terming the action improper and arbitrary. The court observed that the sole reason behind the sudden cancellation was to make way for another appointment, following a note by the Law Minister based on a recommendation from an MLA.
The judgment emphasised that appointments in the legal domain, particularly those involving the government, must follow transparent and fair procedures. The court highlighted that decisions influenced by political considerations undermine the integrity of the process and can erode public confidence in administrative fairness.
Legal experts noted that this ruling sets an important precedent, reaffirming that merit and procedural propriety should guide appointments rather than political influence. The government has been directed to provide explanations and ensure that future appointments adhere strictly to established norms, respecting both the rule of law and the principles of impartial governance.
