Push Back Case Raises Life and Liberty Concerns: Calcutta HC

The Calcutta High Court said the push back case involving residents of West Bengal raises serious concerns about life and liberty. The case concerns Sunali Bibi, her husband Danish, and their eight-year-old son. They were allegedly pushed into Bangladesh on June 26 after detention by Delhi Police. Sunali, who is eight months pregnant, now faces severe risks.

The petition was filed by Bhodu Sheikh, father of Sunali Bibi. He argued that the incident violated fundamental rights and endangered his daughter’s family.

A Division Bench of Justice Tapabrata Chakraborty and Justice Reetobrata Mitra heard the matter. The judges directed the Union Government to file a detailed affidavit. The Court said the Centre must reveal the designated places from which detainees were pushed back.

The Bench noted that the government’s affidavits did not disclose these details. Without this information, deciding on territorial jurisdiction is not possible at this stage. The Court stressed that life and liberty must remain the priority while examining the push back case.
