Supreme Court restores bail after High Court staff mistake

The Supreme Court restores bail for a man after a clerical error by Patna High Court staff caused confusion. The mistake happened in a narcotics case from Bihar’s Vaishali district. The High Court initially granted anticipatory bail to the accused, but staff mistakenly typed “allowed” instead of “rejected” in the court order.

When the error was noticed, the High Court tried to cancel the bail. The accused then approached the Supreme Court, which said the High Court could not undo a signed order simply because of a staff mistake. The court emphasized that legal rules must be followed strictly, and a signed order cannot be changed except for minor clerical errors.

The Supreme Court bench, led by Justices Aravind Kumar and PB Varale, restored the bail. The judges referred to Section 362 of the Criminal Procedure Code, which protects the finality of court orders. They clarified that clerical mistakes should not harm the rights of the accused.

This case highlights the importance of accuracy in court documentation. Even small errors by staff cannot override the law. The Supreme Court’s decision ensures that justice is not delayed or denied due to technical mistakes.
