The commission found that he violated the two-child rule under the Bihar Municipal Act, 2007. This rule stops candidates from contesting local elections if they have more than two children born after April 4, 2008.

A complaint was filed by a former councillor. It said Tiwari hid details about his children in his nomination papers. Officials checked school records and certificates during the investigation. The records showed that three of his children were born after the cut-off date.

After reviewing the evidence, the commission said the affidavit contained false information. It removed him from the post and declared the seat vacant. Authorities have been asked to take legal action for false declaration. Tiwari has said he will challenge the order in court.

Police arrested the accused on the spot. He was identified as Sumit Chaturvedi, an Army soldier from Siwan district. A case was registered based on the constable’s complaint, and further investigation is underway.
