The Supreme Court to pronounce verdict on Waqf Amendment Act 2025 today, a case that has drawn national attention. The matter came before a Bench headed by Chief Justice B.R. Gavai, who heard arguments for three consecutive days in May soon after taking charge.

The Supreme Court to pronounce verdict on Waqf Amendment Act 2025 after over 100 petitioners challenged the law, calling it a “creeping acquisition” of Muslim properties. Petitioners argued that the amendments unfairly expanded government powers over waqf assets.

The Centre, however, defended the legislation, saying it was necessary to curb rampant encroachment on both public and private properties. One major issue under scrutiny is the provision granting power to denotify properties classified as waqf by courts, usage, or deed.

The case first reached the Supreme Court in April, just hours after Parliament passed the Waqf (Amendment) Bill 2025. Chief Justice Gavai’s Bench heard detailed submissions from the petitioners’ advocates as well as Solicitor General Tushar Mehta representing the government.

The upcoming verdict will decide whether the Act’s implementation stays paused or proceeds, marking a significant moment in the ongoing debate over waqf law and property rights in India.

The West Bengal Government argued that Governors and the President cannot interfere with the legislative process by delaying or questioning bills passed by elected Assemblies. It said that the will of the people, expressed through their representatives, must remain supreme.

A five-judge Constitution Bench led by Chief Justice B. R. Gavai heard the matter. The state government stressed that Governors cannot question the competence of laws passed by Assemblies, as such issues fall under the judiciary’s domain.

Senior advocate Kapil Sibal, appearing for West Bengal, said the executive has no authority to block the will of the sovereign people. He emphasized that the Constitution does not allow Governors or the President to interfere in the lawmaking process.

The People’s will can’t be subject to whims of Governors, WB Govt tells SC argument highlighted a key tension between state governments and Governors over pending bills. The bench, however, asked whether bills inconsistent with constitutional provisions must still receive assent.
