A single bench led by Justice Alok Kumar Pandey heard the petition filed by Kumari Poonam. During the hearing, the court was told that the police believed alcohol was being sold under the name of energy drinks. Officials stated that bottles looked similar to popular beer brands like Thunder Bolt and Kingfisher. Some bottles carried names such as Kingfarmer, Kingfeemer, Kallon Golden, and Thousand Volt.

The excise team raided the firm and seized several beverages. They also arrested two employees. Later, government officials informed the court that all products were tested before release. The tests found no alcohol. The state also sent samples to a certified lab, and those results showed the same.

The state said some earlier batches contained alcohol, but the investigated products were alcohol-free. After hearing all sides, the court accepted that the beverages were non-alcoholic. The Patna High Court FIR quash case ended with the FIR being dismissed.

Sharma denied the charges, claiming the woman consented and suggested going to the nursing room. The defence argued the encounter was voluntary but escalated after a remark about her breath. The court rejected this and described Sharma’s actions as “extremely high” in sexual exploitation.

The prosecution sought a sentence of at least four years and six strokes, which was accepted by the court. Sharma faced between two and ten years of imprisonment along with caning. His lawyer had requested a lighter sentence of three to three-and-a-half years with fewer strokes.
