Sudhir Bhagat was arrested in a major Naxalite case but his charges were never framed. The police did not obtain the mandatory prosecution sanction. Because of this delay, the High Court said the trial might not finish soon and granted him bail. The court clarified that keeping an accused in jail for more than 10 years without framing charges violates basic rights.

Meanwhile, the police acted fast in cases involving seven other Naxalites in the same incident. They received prosecution approvals for all seven. But they ignored Sudhir’s file for a decade. This shocking difference has led to many questions about the system’s seriousness.

The case began 11 years ago when 30–40 armed Naxalites attacked a construction company camp in Mishraulia, Sakra. They set vehicles on fire and fled after shouting slogans. The company had refused to pay levy money, which led to the attack.
