Donald Trump has renewed his criticism of birthright citizenship. He said the rule was created for the children of slaves and not for rich foreign visitors who give birth in the United States. He spoke to Politico after the Supreme Court agreed to review the issue.
In January 2025, Trump signed an executive order to end automatic citizenship for children of undocumented immigrants and short-term visitors. Several federal courts blocked the order. The Supreme Court later ruled that district courts cannot issue nationwide orders that stop the government from acting. The justices have now taken up the case directly and expect to rule next summer.
Trump argued that the 14th Amendment supports his view. The amendment was written soon after the Civil War. Lawmakers wanted to protect former slaves and their children. He said it was never meant to give citizenship to families who enter the country for a short stay.
He also said the United States cannot support millions of people who come through birth tourism or illegal entry. The final decision will depend on how the Court interprets the phrase “subject to the jurisdiction.” The ruling could reshape future immigration policy in a major way.
