Why India’s Election Nomination Process Needs Reform

The nomination process for elections in India, governed by the Representation of the People Act (RP) 1951, allows only qualified candidates to contest. However, over the years, this process has become complicated and often focuses too much on technical paperwork rather than real issues with a candidate’s eligibility. Many disqualifications or objections are based on minor procedural errors, rather than serious flaws that affect a person’s ability to serve in public office. Experts argue that this emphasis on technicalities wastes time, courts’ resources, and delays elections. They suggest reforms that simplify verification, focus on important eligibility criteria, and prevent misuse of legal challenges to block honest candidates. A more straightforward system would make the nomination process fairer, efficient, and encourage capable individuals to participate in democracy without unnecessary legal hurdles, ensuring elections reflect the voters’ choice rather than procedural loopholes.
