The No Compassionate Appointment if Earning Member in Family rule received strong backing from the Patna High Court. The court refused to interfere with a government order that denied compassionate employment because the family already had a working member.
The case involved Sittu Kumar, who applied for a government job after the death of his father, a police havildar. However, authorities rejected his application because his elder brother works as a jail police warden and earns a regular salary.
The Begusarai District Compassionate Committee first denied the request. Sittu Kumar then challenged the decision in the High Court. Justice Partha Sarthi reviewed the case but found no error in the government’s policy or the committee’s decision.
The court said compassionate appointments aim to help families facing sudden financial hardship after a government employee’s death. If the family already has a stable income, the rule of No Compassionate Appointment if Earning Member in Family applies and the benefit cannot be granted.
