The debate over Raj Bhavan vs Popular Mandate has intensified in Tamil Nadu after the recent election results produced a hung assembly. No party secured a clear majority, creating uncertainty over who should form the government. The issue has sparked a constitutional and political debate across the state.
In the 234-member assembly, a party needs 118 seats to form the government. The TVK party emerged as the single largest party with 108 seats, falling short of a majority. Congress, which has five MLAs, has reportedly extended support, but the governor has asked the party to show proof of majority before inviting it to form the government.
This situation has triggered the Raj Bhavan vs Popular Mandate debate. Political experts say the majority should be tested on the assembly floor, not at the governor’s residence. They refer to the Supreme Court’s landmark SR Bommai case, which emphasised floor tests to decide legislative strength.
