New Delhi, September 3: The Supreme Court of India has ruled that every child has the child right to affection parents. The court stated that children must not be deprived of the love and emotional bond of either parent, even when parents live apart or in different countries.
The judgment came in a case where a father sought video call access to his nine-year-old son, who currently resides with his mother in Ireland. A bench of Justices Vikram Nath and Sandeep Mehta granted his plea, directing that he be allowed to interact with his son for two hours every alternate Sunday. This, the court said, would protect the child’s emotional health and ensure he continues to feel the presence of both parents in his life.
The Supreme Court stressed that custody disputes or strained relations between parents should never overshadow a child’s welfare. The child right to affection parents is a fundamental part of upbringing, and children should not be forced to choose one parent over the other. The court made clear that affection and guidance from both parents help secure emotional balance and holistic development.
Even as the child remains settled with his mother abroad, the judges found the father’s request reasonable and non-disruptive. The arrangement allows the child to enjoy a stable home while still maintaining meaningful contact with his father.
This ruling is expected to guide future custody and visitation cases, highlighting that the child right to affection parents outweighs disputes. By reinforcing that a child’s welfare must come first, the Supreme Court has strengthened the principle that both parents have continuing roles in a child’s life.
