The Delhi High Court has ruled that the rule prohibiting the transfer of a medical student from one college to another is invalid. A Bench comprising Chief Justice D.K. Upadhyaya and Justice Tejas Karia held that Regulation 18 of the Graduate Medical Education Regulation, 2023 is unconstitutional.
The court said the regulation was “manifestly unreasonable and arbitrary” and therefore violated the Constitution. It observed that a complete ban on student transfers does not consider genuine personal, medical, or family difficulties faced by students. According to the Bench, such a rigid rule fails to provide fairness and flexibility.
The court also noted that regulatory bodies must frame rules that balance discipline with compassion. It said students should not suffer because of inflexible policies, especially when no academic standards are affected.
With this ruling, the prohibition on transferring medical students to another college has been set aside. The judgment is expected to benefit students facing genuine hardships and bring more fairness to medical education regulations across the country.
