Supreme Court Declines to Initiate Contempt Against Lawyer Who Attacked CJI
The Supreme Court on Monday said it was not inclined to initiate contempt proceedings against the lawyer who allegedly attacked Chief Justice of India D.Y. Chandrachud during a recent court hearing. A Bench observed that while shouting slogans or throwing objects inside a courtroom clearly amounts to contempt, it is ultimately for the concerned Judge to decide whether to proceed under the law. The incident had sparked widespread condemnation from the legal fraternity, prompting calls for stricter courtroom security and disciplinary action. The Bench emphasized that courts must maintain their dignity and order but also act with restraint and fairness in such situations. It reiterated that disciplinary measures against advocates fall under the jurisdiction of the Bar Council as well. The court’s stance reflects a measured approach, balancing judicial authority with procedural fairness and the principles of natural justice.
