Supreme Court Stays UGC Equity Rules amid widespread protests and legal challenges across the country. On January 29, 2026, the apex court put a stay on the University Grants Commission (Promotion of Equity in Higher Education Institutions) Regulations, 2026, which the UGC notified earlier this month.
Several petitioners challenged the new rules, calling them arbitrary, discriminatory, and unconstitutional. They also argued that the regulations violated provisions of the UGC Act, 1956. The Court observed that Regulation 3(C), which defines caste-based discrimination, suffers from vagueness and carries a risk of misuse. As a result, the bench said the language needs modification.
Supreme Court Stays UGC Equity Rules and ordered that the 2012 UGC regulations will continue to operate until further notice. The new framework aimed to curb caste-based discrimination by mandating special committees and helplines for SC, ST, and OBC students in colleges and universities.
However, the rules triggered protests from general category students in several cities. Students at Delhi University’s North Campus and Lucknow University held demonstrations, alleging that the regulations promote inequality and lack safeguards for general category representation.
Union Education Minister Dharmendra Pradhan tried to calm concerns and said authorities would prevent misuse of the law. Despite this assurance, dissent grew, and BJP Kisan Morcha leader Shyam Sundar Tripathi resigned, citing strong opposition to the policy.
The Court’s intervention has paused the rollout of the new rules and reopened debate on equity and fairness in higher education.
