His plea highlighted that the order lacked a valid basis. The parole denial row gained more weight when he cited the case of Engineer Rashid, who received permission from a Delhi court to attend Parliament.

Amritpal Singh approached the court after the government refused to allow him to join the winter session of Parliament scheduled from December 1 to 19. His counsel told the court that the state ignored previous directions by dismissing the application without proper reasoning.

A Division Bench led by Justice Ashwani Kumar Mishra listed the matter for hearing on Monday. The petition will likely go before Chief Justice Sheel Nagu, who earlier asked the Home Secretary to decide the plea before the Parliament session.

Amritpal claimed the detention was politically driven and aimed at silencing an elected representative of 19 lakh voters. He also argued that his visit to Parliament would not affect Punjab’s law and order since it lies outside the state.

The Amritpal Singh parole plea reached the Punjab and Haryana High Court after he sought temporary release to attend the winter session of Parliament. A Division Bench told the Punjab government to decide on his request within a week, preferably before the session begins on December 1. The Amritpal Singh parole plea aims to secure his presence in the House as the elected MP from Khadoor Sahib.

Chief Justice Sheel Nagu and Justice Sanjiv Berry questioned senior advocate RS Bains about Amritpal’s preparation for the session. They asked what issues he planned to raise and how he intended to contribute. The judges reminded him that an MP must speak for the public and not remain silent inside Parliament.

Bains argued that Khadoor Sahib is facing a crisis. Almost 800 villages in the constituency are struggling with floods, and he said Amritpal should address this situation in Parliament. He also stated that they sent representations for parole to all authorities on November 13.

Additional Advocate-General Chanchal Singla told the court that Amritpal did not follow the formal format for his request. The Bench then asked the state to treat the representation as a proper application.

Amritpal’s petition highlighted that he won the 2024 Lok Sabha election with a strong mandate despite his NSA detention in Dibrugarh. He urged the court to ensure a timely decision so he can carry out his parliamentary duties.

The Punjab and Haryana High Court will hear MP Amritpal Singh’s parole request on November 21. He seeks temporary release to attend the winter session of Parliament scheduled from December 1 to 19. His application cites Section 15 of the National Security Act, which allows parole in exceptional situations. The case is drawing attention because HC to Hear Amritpal Singh parole plea at a time when constitutional responsibilities and detention laws directly overlap.

During the preliminary hearing, the Division Bench led by Chief Justice Sheel Nagu questioned the status of Amritpal’s main plea challenging his NSA detention. The court asked how he could participate in Parliament while the detention order remains active. His counsel argued that both matters operate independently and pointed out that Amritpal previously received a brief release to take oath as a Member of Parliament.

Amritpal stated through his petition that he represents nearly 19 lakh people in Khadoor Sahib and has a constitutional duty to speak for them in Parliament. Although detained in Dibrugarh since April 2023, he won the 2024 Lok Sabha election by a significant margin, which he believes strengthens his claim for temporary release.

Fresh representations submitted on November 13 to the Union and state governments remain pending. His counsel stressed that the delay prevents him from fulfilling parliamentary duties and urged the court to direct authorities to decide quickly or allow his physical attendance during the winter session.

The court will continue examining the applicability of Section 15 and whether exceptional grounds exist for parole. A detailed outcome is expected after the next hearing on Friday.
