The Punjab and Haryana High Court will hear MP Amritpal Singh’s parole request on November 21. He seeks temporary release to attend the winter session of Parliament scheduled from December 1 to 19. His application cites Section 15 of the National Security Act, which allows parole in exceptional situations. During the preliminary hearing, the Division Bench led by Chief Justice Sheel Nagu questioned the status of Amritpal’s main plea challenging his NSA detention. The court asked how he could participate in Parliament while the detention order remains active. His counsel argued that both matters operate independently and pointed out that Amritpal previously received a brief release to take oath as a Member of Parliament.
Amritpal stated through his petition that he represents nearly 19 lakh people in Khadoor Sahib and has a constitutional duty to speak for them in Parliament. Although detained in Dibrugarh since April 2023, he won the 2024 Lok Sabha election by a significant margin, which he believes strengthens his claim for temporary release.
Fresh representations submitted on November 13 to the Union and state governments remain pending. His counsel stressed that the delay prevents him from fulfilling parliamentary duties and urged the court to direct authorities to decide quickly or allow his physical attendance during the winter session.
The court will continue examining the applicability of Section 15 and whether exceptional grounds exist for parole. A detailed outcome is expected after the next hearing on Friday.
