With the Election Commission announcing poll dates in Bihar, the scope for Supreme Court intervention has significantly narrowed — at least for now. The model code of conduct is in force, and the electoral process has officially begun, triggering the principle of judicial restraint during active elections.
Historically, the Supreme Court has avoided interfering in poll processes unless there’s a matter of grave constitutional violation. Challenges to electoral rolls, candidate eligibility, or alleged procedural lapses are typically addressed post facto through election petitions.
Moreover, the Court is cautious not to be seen as influencing democratic processes during their course. This separation preserves the autonomy of the Election Commission and maintains public faith in electoral institutions.
While ongoing petitions may still be heard, direct intervention in the conduct or scheduling of polls in Bihar is unlikely — unless a clear, urgent violation of fundamental rights emerges.
