Karnataka HC Halts State Order Requiring Permission for Public Gatherings
The Karnataka High Court has stayed the State Government’s recent order that sought to regulate the activities of private organisations on public land. The Government Order (GO) required prior permission for any gathering of more than 10 people, citing concerns over public safety and misuse of open spaces.
The petitioner, a Bengaluru-based organisation, argued that the order violates fundamental rights to freedom of speech and assembly guaranteed under the Constitution of India. It contended that the rule was arbitrary, lacking clear guidelines, and disproportionately restricted public participation in lawful events.
The High Court observed that the order could have a chilling effect on legitimate civic and cultural activities and therefore issued an interim stay.
The State Government has been directed to file a response within two weeks. The case will be heard further after the court reviews the government’s justification for imposing such restriction
