Madras High Court Bars Interim Bail for Convicts Awaiting Government Decision on Premature Release

The Madras High Court has ruled that it will no longer entertain interim bail pleas from convicts awaiting government decisions on premature release. The decision was delivered by a bench comprising Justices N. Sathish Kumar and M. Jothiraman, who termed the earlier practice “impermissible” and directed that it be discontinued.
This move ends a procedure that had been in place since 2016, where convicts seeking premature release from imprisonment could approach the High Court for temporary relief while awaiting the government’s decision. The bench observed that such interim measures bypassed proper administrative processes and could undermine the functioning of statutory release mechanisms.
