Bihar Elections High Court rulingThe Bihar Elections High Court ruling has dealt a setback to RJD’s Tejashwi Yadav and LJP leader Pashupati Paras. The Patna High Court dismissed petitions challenging the cancellation of nominations of RJD candidate Shweta Suman from Mohania and RLJP candidate Rakesh Kumar Singh from Ghosi. Justice A. Abhishek Reddy ruled that such issues can only be contested through an election petition after the polls.
The Bihar Elections High Court ruling noted that both nominations were rejected for technical reasons. Shweta Suman’s papers lacked a caste certificate, while Rakesh Kumar Singh failed to tick the column about his criminal history. Their lawyers argued that the returning officers had ignored legal procedure. However, the court observed that the election process had already begun, and ballot papers were printed.
Advocate General PK Shahi and Election Commission lawyer Siddharth Prasad stated that the High Court cannot interfere once voting starts. The judgment allows both candidates to challenge the outcome after elections through a proper petition.
